Subscription Terms and Conditions

1.About This Agreement
These Terms and Conditions govern access to the Your Property Strategy off market Property Portal (the Portal), operated by DA & NL Ronson Pty Ltd ATF The Ronson Family Trust (we, us, our), trading as Your Property Strategy (RLA 297515).
By subscribing to or accessing the Portal, you acknowledge that you have read, understood, and agree to be bound by these Terms.
2.Nature of the Portal (Important)
The Portal is a general informational service only. It provides subscribers with access to general market commentary and property information based on buyer's agent experience. It is not a professional advisory service.
The Portal and all listings and content contained within it are:
- Not personal financial advice
- Not legal advice
- Not investment advice
- Not a recommendation to purchase any property
- Not tailored to your individual objectives, financial situation, or needs
- Not prepared for use by lenders, financial institutions, or mortgage brokers
No fiduciary, advisory, or agency relationship is created by your subscription to or use of the Portal. To the fullest extent permitted by law, we do not owe you a duty of care in relation to the Portal or its content beyond the obligations expressly set out in these Terms.
3.No Reliance
You acknowledge and agree that:
- Portal content must not be relied upon for any purpose whatsoever, including (without limitation) financial, investment, lending, legal, taxation, or purchasing decisions.
- Portal content is not prepared for use by, and must not be provided to, lenders, financial institutions, or mortgage brokers for lending purposes.
- Any reliance placed on Portal content is at your sole risk.
- You should obtain independent professional advice before making any property or financial decisions.
- It is unreasonable to rely on Portal listings or information without obtaining such independent advice.
4.Listing Availability and Accuracy
You acknowledge and agree that:
- Listings on the Portal are provided for general informational purposes only and do not constitute a guarantee that any property is available for sale, inspection, or negotiation.
- Property information, including price, specifications, and availability, may change or be withdrawn at any time without notice.
- Portal content may be affected by incomplete or inaccurate data from third party sources, including sales databases and property listings. We make no warranty as to the accuracy or completeness of such data.
- We make no warranty, representation, or guarantee as to the suitability, accuracy, completeness, or fitness for any particular purpose of any listing or information on the Portal.
- The presence of a listing on the Portal does not constitute a representation that we act as agent for the seller of that property, unless separately agreed in writing.
- Off market listings are shared with the consent of the relevant agent or vendor. We do not guarantee the ongoing availability of any listing.
- The Portal is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted access, availability, or that the Portal will be free from errors, delays, outages, or defects.
5.Subscription
5.1 Monthly Subscription
Access to the Portal is provided on a monthly subscription basis. The subscription fee is as advised to you at the time of engagement. Fees may be varied with 30 days written notice.
5.2 Billing and Payment
Subscription fees are charged monthly in advance. Payment must be received prior to access being granted or renewed for each billing period.
5.3 Cancellation
Either party may cancel the subscription at any time. Cancellation will take effect at the end of the current billing period. No refunds are provided for unused portions of a billing period.
5.4 Right to Suspend or Refuse Access
We reserve the right to suspend, restrict, or cancel access to the Portal at our discretion, including where these Terms are breached, where a conflict of interest exists, or where we determine it is otherwise appropriate to do so.
6.Access Credentials and Security
Access credentials (including any password or link provided) are for your personal use only and must not be shared with any third party.
You are responsible for maintaining the confidentiality of your access credentials. We reserve the right to immediately suspend access if credentials are shared, misused, or compromised.
7.Confidentiality
All listings, information, and materials accessible through the Portal are confidential.
You must not:
- Share, reproduce, distribute, or publish any Portal listing or content without our prior written consent.
- Use Portal information to approach sellers, agents, or third parties directly in a manner that circumvents or bypasses Your Property Strategy.
- Submit or provide Portal content to any lender, financial institution, or mortgage broker.
- Use Portal content for any commercial purpose.
You may share Portal content privately for discussion purposes. We do not accept responsibility for any reliance placed on Portal content by third parties.
You must notify us immediately if you become aware of any unauthorised access to or disclosure of Portal content.
8.Relationship to Buyer's Agency Services
A subscription to the Portal does not constitute a buyer's agency agreement between you and Your Property Strategy.
By subscribing to the Portal, you do not become a buyer's agency client of Your Property Strategy.
A buyer's agency relationship only arises if and when you enter into a separate written Buyer's Agency Agreement with us, executed in accordance with applicable legislation.
9.Limitation of Liability
To the maximum extent permitted by law:
- We exclude all liability for any loss, damage, cost, or expense (including indirect or consequential loss) arising from your use of or reliance on the Portal or any listing or content contained within it.
- We are not liable for any failure to secure a property listed on the Portal, or for any loss arising from a property being sold to another party.
- Our total liability to you for any claim arising under these Terms shall not exceed the total subscription fees paid by you in the three months preceding the claim.
Nothing in these Terms excludes any consumer guarantees that cannot be excluded under the Australian Consumer Law.
10.Privacy
We collect and handle your personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy. We will not disclose your personal information to third parties without your consent, except as required by law.
11.Governing Law
These Terms are governed by the laws of South Australia.
Any dispute arising under or in connection with these Terms is subject to the exclusive jurisdiction of the courts of South Australia.
